Superior Disposal LLC — Residential & Commercial Waste Collection
By signing up for waste collection service with Superior Disposal LLC ("Superior Disposal," "we," "us," or "the Company"), the customer ("you" or "Customer") agrees to the following terms and conditions. These terms apply to all residential and commercial collection accounts unless a separate written agreement states otherwise.
1. Cart Ownership
- All trash and recycling carts ("cans" or "carts") provided to the Customer remain the sole property of Superior Disposal LLC at all times.
- If service with Superior Disposal ends for any reason (cancellation, non-payment, move, or otherwise), the Company reserves the right to recollect its cart(s) from the service address.
- If Superior Disposal is unable to recover a cart — including but not limited to the Customer withholding access, discarding, damaging, or losing the cart — the Customer will be charged an additional $75.00 replacement fee per cart.
- The Customer is responsible for keeping the cart reasonably clean and in good condition during the service period, normal wear and tear excepted. The Customer may not deface, paint, label, or otherwise permanently alter the cart.
- If a cart is lost, stolen, or damaged (beyond normal wear and tear, including defacement) while in the Customer's possession, the Customer will be charged the same $75.00 replacement fee.
2. Cart & Driveway Access
- The Customer is responsible for keeping the driveway, access path, and area around the cart clear and unobstructed so that our trucks and crew can safely reach and service the cart.
- Superior Disposal reserves the right to skip a pickup, without refund or credit, if access to the cart is blocked or unsafe (including but not limited to vehicles, gates, low-hanging branches, debris, or standing water).
3. Backdoor / Driveway ("Valet") Service
- Backdoor or driveway pickup service, where our truck enters the Customer's driveway to collect the cart, is provided at the Customer's request and is subject to driveway conditions on the day of service.
- Superior Disposal reserves the right to refuse backdoor service, temporarily or permanently, if in the driver's judgment the driveway's width, grade, surface, or condition does not safely accommodate our vehicles.
- By requesting backdoor service, the Customer acknowledges the inherent risk of vehicle access on private driveways and agrees that Superior Disposal LLC, its owners, and employees are not liable or responsible for damage to the driveway, driveway surface, edging, landscaping, or related property caused by our trucks while performing backdoor service.
- If backdoor service is refused or discontinued due to driveway conditions, the Customer's cart will be serviced at the curb going forward unless other arrangements are made.
4. Billing & Payment
- Invoices are billed on Net 15 terms. Payment is due within 15 days of the invoice date.
- Accounts unpaid after 15 days are considered delinquent.
- Superior Disposal reserves the right to refuse pickup service on any account with a past-due balance.
- Accounts unpaid after 30 days are subject to being locked, resulting in suspension of service until the balance is paid in full.
- Once payment is received on a locked account, please allow up to 3 business days for the account to be unlocked and service to resume. Superior Disposal is not responsible for missed pickups that occur during this reinstatement period.
- Superior Disposal reserves the right to adjust service rates from time to time. Customers will be given advance notice of any rate change.
5. Cancellations & Refunds
- The Customer may cancel service at any time. Cancellations may occur mid billing-cycle; however, no refund or credit will be issued for the remainder of the billing period in which the cancellation occurs.
- Any outstanding or past-due balance on the account at the time of cancellation remains owed to Superior Disposal and does not get forgiven by cancelling service.
- Customers enrolled in a discounted annual (yearly) payment plan are not eligible for a refund, prorated or otherwise, if they cancel service before the end of the paid annual term. The annual rate is offered specifically in exchange for the full-year commitment.
- Upon cancellation, the Customer must make the cart available for pickup by Superior Disposal. See Section 1 (Cart Ownership) regarding the $75.00 fee if the cart is not recovered.
6. Cart Placement & Collection Standards
- Unless backdoor service has been arranged, carts must be placed at the curb, at least 3 feet clear of any object (mailboxes, vehicles, other carts, trees, poles, etc.), by 6:00 AM on the scheduled pickup day.
- Cart lids must be closed, and material must be contained within the cart. Superior Disposal is not obligated to collect loose items placed beside the cart or material that causes the lid to remain open.
- Superior Disposal reserves the right to refuse collection of carts contaminated with prohibited material or that otherwise pose a safety hazard to our crew or equipment.
- Hazardous waste, liquids, hot ashes, construction/demolition debris, tires, batteries, electronics, and similar prohibited materials may not be placed in the cart unless a special arrangement has been made.
7. Missed Pickups & Service Delays
- If a scheduled pickup is missed by Superior Disposal, the Customer should report it within 48 hours so it can be corrected.
- If the cart was not placed out for collection by the required time on the scheduled pickup day, Superior Disposal is under no obligation to return for that cart before the next scheduled pickup.
- Service may occasionally be delayed due to weather, road conditions, holidays, or other circumstances outside our control. Such delays do not constitute a missed pickup and do not entitle the Customer to a refund or credit.
8. Limitation of Liability
- Except as otherwise stated in these terms (including Section 3 regarding backdoor service), Superior Disposal's liability for any claim arising from service is limited to the cost of the service in question. Superior Disposal is not liable for indirect, incidental, or consequential damages.
9. Changes to These Terms
- Superior Disposal may update these Terms and Conditions from time to time. Customers will be notified of material changes, and continued use of service after notice constitutes acceptance of the updated terms.
10. Governing Law
- These terms are governed by the laws of the State of Tennessee.
